Terms and Conditions – Omery.eu

General

These Terms and Conditions govern the relationship between Graphic.lv (owner of www.omery.eu, located at Valentina 16, LV-1083 Riga, Latvia, Registry No. 40103353085, VAT No. LV40103353085, email: info@omery.eu) – referred to as the “Merchant” – and any individual or entity purchasing from the webstore – referred to as the “Customer”.


Prices

  1. All product prices listed on www.omery.eu are in euros (€) and include 21% VAT.

  2. The minimum order amount is €15 (VAT included).

  3. The Merchant reserves the right to adjust prices at any time. However, for orders already placed and paid, the prices valid at the time of purchase will apply.

  4. The Merchant reserves the right to cancel any order if pricing errors occur due to technical issues.

Orders

  1. For help placing orders, please refer to our [ordering guide].

  2. Most products available for order are in stock. Some special items and colors are made to order and may require additional delivery time. This will be clearly stated on the product page.

  3. Product photos are illustrative. While we strive for accuracy, we cannot guarantee that descriptions, specifications, or images are completely error-free.

  4. If an item is unavailable due to inventory error, the Customer will be notified. We may offer an equivalent item or issue a full refund within 10 business days.

  5. Orders paid via Bank Transfer must be completed within 5 working days of order placement. Otherwise, the order will be automatically canceled.

  6. If payment by PayPal or credit card is not received, the order will be canceled by the next business day.


Delivery

  1. Orders are dispatched within 4 business days after payment is received. Often, items are shipped the same or next day (including Saturdays).

  2. Customers must ensure that delivery details are accurate to avoid delays.

  3. The Merchant is not liable for delays caused by postal or courier services after dispatch. Estimated delivery time is about 1 week worldwide.

  4. For orders outside the European Union, the Customer is responsible for any custom duties, taxes, or import fees.


Returns

  1. Customers have the right to withdraw from the purchase within 14 days of receiving their order.

  2. Returns are accepted only if the product is unused, in its original condition, and includes all tags, labels, and packaging.

  3. Return shipping costs are the responsibility of the Customer.

  4. To initiate a return, the Customer must complete the return form (available here: [Download Link]) and email it to info@omery.eu within 14 days of receiving the order. A printed copy must also accompany the returned item.

  5. Upon request, proof of shipment must be provided showing the return was initiated within the 14-day period.

  6. Refunds will be issued within 14 days of receiving the returned goods, using the same payment method (Bank, Credit Card, PayPal). Shipping fees are non-refundable.

  7. If returned items are used, damaged, or not in original condition, the Merchant may reduce the refund to reflect the depreciation.


Force Majeure

The Merchant is not responsible for delays or damages caused by unforeseen events or circumstances beyond its control (e.g., natural disasters, strikes, pandemics, or disruptions in transport or supply).


Personal Data Protection

  1. By placing an order, the Customer agrees to the processing of their personal data (name, address, phone number, email) for order fulfillment and delivery purposes.

  2. All data is handled confidentially. The Merchant collects only the necessary information required to process orders and maintain customer relationships. Customer data is never shared with third parties unless required for shipping or by law. Customers may request that their data be removed from our system.

  3. Payment data is securely processed by PayPal and SEB Bank, using encrypted connections. These providers do not store or use personal data for any secondary purposes.


Warranty and Complaints

  1. All products come with a 2-year warranty covering manufacturing and hidden defects. To report a defect, Customers must contact the Merchant for instructions.

  2. The warranty does not cover:

    • Damage due to misuse or failure to follow care instructions

    • Wear and tear from normal use

    • Environmental damage (e.g., sand, mud, water exposure)

    • Items that have been self-repaired or altered

    • Consumable items like lures, hooks, lines, and accessories

  3. Only products purchased from Omery.eu are covered by this warranty.

  4. To file a complaint, Customers must email info@omery.eu with their name, phone number, order number, and a description of the issue. The item must be shipped back within 14 days of filing the complaint.

  5. Defective product complaints must be submitted within 14 days of noticing the issue. Use of the item must stop once a fault is discovered.

  6. The Merchant forwards warranty cases to the manufacturer for expert evaluation. Based on the result, the product may be replaced or refunded within 14 days.

  7. If the item is not found to be defective, or the issue was caused by misuse, the Customer will be charged a €35 service fee (VAT excluded). Processing times depend on the manufacturer, but the Merchant will make efforts to expedite the process.

  8. Complaints are reviewed within 5 business days of receipt.


Other Terms

  1. The Merchant responds to all customer inquiries within 5 business days.

  2. In case of disputes, the Merchant will seek a fair solution through negotiation. If resolution cannot be reached, Customers may contact the Consumer Rights Protection Centre in Latvia or the European Consumer Centre for cross-border disputes.
